Workfly
Terms of Use
In this document 14 sections
These Terms govern the use of the Workfly app and website in Spain and Portugal.
1. Who provides the service
Workfly is offered by Ramon da Cruz Amaro, an individual residing at Avenida del Doctor Jiménez Díaz, 26, Alicante (Spain). Contact: privacidad@workfly.es.
Contact: privacidad@workfly.es in Spain and privacidade@workfly.pt in Portugal, as well as support inside the app.
2. Acceptance
By creating an account, you confirm that you have read and accept these Terms and that you have read the Privacy Policy. If you do not agree, do not use Workfly.
3. What Workfly does
Workfly connects clients and professionals (self-employed people and businesses): it lets you post requests, receive and send quotes, exchange messages and book appointments.
Workfly does not provide the services offered and is not a party to the agreement between client and professional. Price, date, payment method and the conditions of the service are agreed directly between the two of them.
4. Accounts
Workfly is only for people aged 18 or over. Each person may have a single account, with true and up-to-date information, and is responsible for keeping their password secret.
Identity verification is optional: whoever completes it gets the verified badge on their profile, under the conditions described in the Privacy Policy. The badge shows that a person on our team checked the document; it is not a guarantee about the quality of the service.
5. Free of charge
Workfly is free for clients and professionals. We do not charge a monthly fee, a fee per quote, a fee per appointment or a commission on services. Payment for each service is made directly between client and professional, and Workfly receives no part of it.
6. Responsibilities
The professional is responsible for carrying out the service, for its quality and safety and for meeting the legal and tax obligations of their activity.
The client is responsible for the information given in the request and for keeping to what they agree with the professional.
Each user is responsible for what they post: texts, photos, reviews and messages.
7. Acceptable use
You agree not to use Workfly to:
- commit illegal acts or fraud;
- harass, threaten or discriminate against other people;
- send spam or unsolicited advertising;
- post false information or content that infringes the rights of others;
- get around the platform's security measures or access other people's data.
8. Reports and moderation
In the app you can report a profile, a business, a conversation, a request, an appointment or a review, giving the reason (spam, harassment, inappropriate content, fraud or other). You can also block another user. To flag illegal content without an account, write to the email for your country stating where the content is and why you consider it illegal.
A person on our team reviews every report. Depending on how serious it is, we may remove the content or restrict or block the account. When we restrict your account or your content, our team tells you by email the reason and how to challenge the decision; you can challenge it at the email for your country or through support in the app, and a person reviews the challenge.
Point of contact for authorities and users (Digital Services Act, arts. 11 and 12): privacidad@workfly.es and privacidade@workfly.pt, in Spanish, Portuguese or English.
Legal representative in the European Union (Digital Services Act, art. 13): not applicable, because the provider is established in Spain.
9. How we order results and the ranking
Search. When you choose professionals for a request, the order gives more weight, in this sequence, to: your favorites; whoever works in the request's city (or, with less weight, in the same region); and whoever has the same profession (or, with less weight, the same category). In searches without a request, and among professionals who tie on these criteria, the ranking score counts first, then how complete the profile is; businesses follow the ranking score and then the average rating. When a search shows both together, the lists are interleaved in proportion to the size of each one. When you search for businesses near a place, they are ordered by distance from that place.
Ranking. The score goes from 0 to 1000 and adds up five groups:
- reputation (up to 300): average rating and number of reviews; with no reviews, this group is worth zero;
- completed services (up to 300): jobs finished with clients;
- activity (up to 200): for professionals, quotes sent, replies to the invitations received and an active schedule; for businesses, active services, team and an active schedule;
- complete profile (up to 150): how complete the profile is;
- referrals (up to 50): people you invited who started using Workfly.
When scores are tied, whoever joined Workfly first comes first. Nobody pays to appear in a better position.
10. Limitation of liability
Workfly is liable for the operation of the platform and for damage it causes through its own fault, as provided by law. It is not liable for the performance, quality or outcome of the services agreed between users, or for the content users post.
Nothing in these Terms limits the rights that your country's consumer protection law gives you.
11. Changes
When these Terms change, we publish a new version with the update date and ask you in the app to accept it. If you do not accept it, you can close your account.
12. Closing the account
You can delete your account at any time in the app itself. We may suspend or close an account that breaches these Terms seriously or repeatedly, giving the reason, as described in section 8.
13. Governing law and jurisdiction
If you use Workfly as a consumer, these Terms are governed by the law of the country where you have your habitual residence, and any dispute may be brought before the courts of the consumer's domicile. Workfly may only bring proceedings against the consumer before the courts of that domicile.
